Terms & Conditions

The terms and conditions (hereinafter referred to as “Terms and Conditions”) mentioned herein is applicable to the usage of the “THINK Gas Mileage+ card”. The Terms and Conditions, specified below govern and constitute the entire agreement and/or arrangement between you and Think Gas Distribution Pvt. Ltd. (Think Gas) in relation to the “THINK Gas Mileage+ card”, as amended from time to time at the at the sole discretion of Think Gas. By completing the sign-up process for availing the “THINK Gas Mileage+ card”, you are deemed to have expressly read, understood and accepted each and every Terms and Conditions mentioned herein. You agree to be bound by all the Terms and Conditions mentioned herein, as may be amended from time to time, at the sole discretion of Think Gas. If we believe a violation of these Terms and Conditions is deliberate, repeated or presents a credible risk of harm to us, the Program or any third parties, we may suspend or terminate your access.

Definitions

"THINK Gas Mileage+ card" means the pre-paid closed loop cards for use by Members at Think Gas ROs exclusively for the purchase of goods and services from such Think Gas ROs.THINK Gas Mileage+ card.
‘Think Gas RO’ means participating Think Gas Outlets (CNG Stations) at which the THINK Gas Mileage+ card- would be accepted.
"Program" means the Think Gas Program to offer the THINK Gas Mileage+ card to the Member.
‘Member’ means a Member of THINK Gas Mileage+ card.
‘Data’ means the information, including the personal information collected from the Member for the issuance of the THINK Gas Mileage+ card.

Membership Enrolment

• Membership of the THINK Gas Mileage+ card is open to all individuals who are aged 18 (eighteen) years or more by Pre-login and registration at https://cards.think-gas.com or Login at POS Terminals installed at THINK GAS ROs.
A Member is required to pay a non-refundable enrolment fee.
On applying for a THINK Gas Mileage+ card, registration will be successful on the submission of proof of identity in order for a THINK Gas Mileage+ card to be issued in his/her name. Think Gas accepts Pancard, Aadhar, Passport, VoterID etc. as proof of identity. All data will be collected, stored and processed in accordance with THINK Gas Privacy policy.
The THINK Gas Mileage+ card will be handed over to the Member on the spot at the Think Gas RO after successful registration and on payment of the enrollment fees.
All THINK Gas Mileage+ cards will have a PIN feature based on which each transaction on the THINK Gas Mileage+ card will be completed.
The THINK Gas Mileage+ card is non-transferable and intended for personal use only. Any liability arising due to card loss, misuse, or out of sharing of PIN consciously or otherwise, would render the Member liable for all losses.
The Member will be solely responsible for the inconvenience or inability to use his/her THINK Gas Mileage+ card due to incorrect PIN till the time a request for a new PIN is initiated through the Think Gas Customer Care. The Member should take adequate precautions to protect the THINK Gas Mileage+ card from theft and loss and/or damage.
Should a Think Gas Card be lost, a fresh application can be made for a replacement card on payment of a fee. The applicable fee for such replacement would be made available on request and can be viewed on the website of Think Gas.
Any loss of THINK Gas Mileage+ card should be intimated to THINK GAS Helpline immediately and THINK GAS shall arrange to hotlist the card. However, THINK GAS will not be liable for any misuse of the lost THINK Gas Mileage+ card during the interim period until the THINK Gas Mileage+ card is hot listed.
If the hot listed THINK Gas Mileage+ card is subsequently found, it cannot be de-hot listed and the Member will have to apply for a replacement card.
All communication will be deemed to have been received by the Member and THINK GAS bears no responsibility for communication not received or lost in the mail.

Loading and Payment

• The THINK Gas Mileage+ card will have the electronic equivalent of cash loaded on the card which will be referred to as e-cash. The amount can be loaded by the Manager of the THINK GAS RO having the loading facility.
The amount can also be loaded through many online & E- wallet options. The details are available at https://cards.think-gas.com.
The e-cash is a payment towards future purchases for goods and services at Think Gas ROs.
The minimum load amount at each time would be Rs.200 per card. Any additional amount desired to be loaded will have to be in the multiples of Rs. 100/-. The maximum balance which can be loaded to the THINK Gas Mileage+ card shall be INR [].
The Member shall not withdraw or redeem cash from the balance in the THINK Gas Mileage+ card.
Think Gas shall not be liable to pay any interest on any balance maintained in the THINK Gas Mileage+ card at any point in time.
Think Gas shall inform the Member prior to the expiry of the THINK Gas Mileage+ card through SMS on the registered mobile number of the Member.

Availability

We make no guarantee as to availability, quality or service levels of the Program on a 24x7 basis or promise uninterrupted access to the Think Gas website. Disruption of the Program may arise due to technical or operational difficulties, and no prior notice of downtime will be given to you in such circumstance. We may also suspend the Program for specific users permanently or temporarily for any reason whatsoever, including while investigating complaints or alleged violations of these Terms and Conditions.

Intellectual Property

The Think Gas website and material pertaining to the Program contains copyrighted material, trademarks, proprietary information and other intellectual property owned by Think Gas and its licensors. Except for that information which is in the public domain or for which you have been given permission, you agree not to copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Access to or use of the Think Gas website or the Program does not confer and should not be considered as conferring upon anyone any license to Think Gas's or any third party’s intellectual property rights. Any use of the Program or its contents without the permission of Think Gas is prohibited.

Disclaimer

We provide the Program and the content on the Think Gas website on an "as is" basis and grant no warranties of any kind, whether express, implied, statutory or otherwise with respect to the Program. We specifically disclaim any implied warranties of fitness for a particular purpose or non-infringement. You expressly agree that the use of the Program is at your own risk.

Indemnity

You agree to indemnify and hold harmless Think Gas, its subsidiaries, affiliates, officers, directors, agents, and third parties, for any losses, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of the website and the Program and/or arising from a breach of these Terms and Conditions, any violation of third party data protection rights and/or any fraudulent act on your part.

General

All interpretations of Program Terms and Conditions shall be at the sole discretion of THINK GAS.
THINK GAS reserves the right to add, modify, delete or otherwise change any of the terms, conditions, benefits, rewards or reward level pertaining to the Program at its sole discretion, with or without notice.
Any change of information of the Member must be notified on our Helpline Nos. and emailed to us at support@ThinkGascard.com.
Nothing in the - Program Terms and Conditions is intended or shall be construed to create or establish any agency, partnership or joint venture relationship between THINK GAS and the Members and partners.
Each Member is responsible for remaining knowledgeable as to the Program Terms and Conditions and THINK GAS will send Email and SMS to Members to advise them of matters of interest, including notification of Program changes. However neither THINK GAS nor its service providers, partners, affiliates or the Think Gas ROs will be liable for any failure to do so and will not be responsible for correspondence lost or delayed in the mail. The latest Terms and Conditions shall be available to the Member on request or can be viewed on the website of the Program.
All telephone instructions received and verified shall be deemed proper and THINK GAS shall not be liable for executing these instructions in good faith. All such telephone instructions will be treated as having been written and signed.

Termination

Any violation or breach of the Terms and Conditions may lead to automatic suspension or termination of your account and access to the Website and the Retail Program, and we shall not be responsible or liable for any damages in this regard. The termination of the Terms and Conditions will not affect any liability that may have arisen prior to the date of termination.
Think Gas may at its sole discretion terminate the THINK Gas Mileage+ card in the event (i) the Member commits breach of any of the terms, conditions, stipulations or its obligations under these ‘“Terms and Conditions”’ (iii) any restriction imposed on the Member by an order of a competent Court or order issued by any regulatory or statutory authority in India or any investigating agency (iv) the Program becomes illegal under the applicable laws, rules, guidelines or circular and (v) the entire Program is terminated.
The Program has no predetermined termination date and may continue until such time as THINK GAS decides to terminate the Program, at any time, with or without notice.

Governing Law

Terms and conditions of the Retail Program are governed by the laws of the Republic of India and will be restricted to the exclusive jurisdiction of courts in Delhi.

Entire Agreement

These Terms and Conditions, together with the and Privacy Policy, as accepted by you upon accessing the website or using the Retail Program, constitutes the entire agreement between you and Think Gas. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect and shall survive termination of the Fleet Program.

Grievances and Complaints

In accordance with the requirements under the Information Technology (Intermediaries Guidelines) Rules, 2011, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 and the Consumer Protection (E-Commerce) Rules, 2020,

Definitions

"Data" means the information, including the personal information collected from the Fleet Member for the issuance of the THINK Gas Mileage+ card.
“THINK Gas Mileage+ card” means the pre-paid closed loop cards for use by Fleet Members at Think Gas ROs exclusively for the purchase of goods and services from such Think Gas ROs. THINK Gas Mileage+ card
“THINK GAS RO” means the participating THINK GAS outlets (CNG pumps) at which the THINK Gas Mileage+ card will be accepted
“Fleet Member” means a member of the THINK Gas Mileage+ card Fleet Program which is, any business entity or individual controlling a fleet of vehicles used for commercial purposes. Fleet Membership should be construed accordingly.
"Fleet Program" means the THINK Gas Mileage+ card Fleet Program that makes available the THINK Gas Mileage+ cards to Fleet Members.
THINK Gas Mileage+ card “Vehicle” refers to any CNG consuming unit.

Membership & Enrollment for THINK Gas Mileage+ card- Fleet

Any business entity or individual with fleet size of minimum 2 vehicles used for commercial purposes and has a permit for commercial transit is eligible to enroll into the THINK Gas Mileage+ card Fleet Program.
Any individual designated by the Fleet Member for using the THINK Gas Mileage+ card must be above 18 years of age.
Applicants for Fleet Membership can only apply for the pre-paid facility on the Think Gas Card on the submission of documentary proof of the business pertaining to the Fleet
Incomplete and unsigned applications for Fleet Membership are liable to be rejected.
THINK GAS reserves the right to grant or refuse membership to THINK Gas Mileage+ card Fleet Program.
Each Fleet Member will be given only one Think Gas Card per vehicle. THINK Gas Mileage+ cards will be delivered to the Fleet Member's authorized representative only after successful registration, upon receiving the enrollment fee and verifying the complete application form along with the supporting documents.
The Fleet Member should take adequate precautions to protect the THINK Gas Mileage+ cards and prevent damage.
Should a THINK Gas Mileage+ card be lost, a fresh application can be made for a new THINK Gas Mileage+ card on payment of applicable fee. The applicable fee for such replacement can be viewed at the website of Think Gas.
All THINK Gas Mileage+ cards will be provided with a PIN feature to be activated on first usage and based on which each transaction on the THINK Gas Mileage+ card will be completed.
Any liability arising due to the loss, misuse, or out of sharing of PIN consciously or otherwise, would render the Fleet Member liable for all losses.
The loss of the THINK Gas Mileage+ card should be intimated to the help desk immediately, and THINK GAS shall arrange to hotlist the Think Gas Card. However, THINK GAS will not be liable for any misuse of the THINK Gas Mileage+ card during the interim period until such THINK Gas Mileage+ card is hotlisted.
Any change of information as provided in the THINK Gas Mileage+ card application form must be notified to THINK Gas Mileage+ card - Fleet Service Centre.
THINK Gas Mileage+ card -Fleet Program has no predetermined termination date and may continue until such time as THINK GAS decides to terminate the Program, at any time, with or without notice.
The enrollment fee is non-refundable.
All communication will be sent to the address given in the THINK Gas Mileage+ card application form and it is the responsibility of the Fleet Member to inform THINK Gas Mileage+ card -Fleet Service Centre about any changes in the address.
All communication will be deemed to have been received by the Fleet Member and THINK GAS bears no responsibility for communication not received or lost in the mail or courier.
All telephone instructions received and verified shall be deemed proper and THINK GAS shall not be liable for executing these instructions in good faith. All such telephone instructions will be treated as having been written and signed.

The Fleet Member shall not withdraw or redeem cash from the balance in the THINK Gas Mileage+ card.
Think Gas shall not be liable to pay any interest on any balance maintained in the THINK Gas Mileage+ card at any point in time.

Termination

The -Fleet Program has no predetermined termination date and may continue until such time as THINK GAS decides to terminate the Program, at any time, with notice.

THINK Gas Mileage+ card Fleet Program is governed by the laws of the Republic of India and will be restricted to exclusive jurisdiction of Delhi under the Delhi High Court.
Each Member is responsible for remaining knowledgeable as to the Fleet Program Terms and Conditions and THINK GAS will send Email and SMS to Fleet Members to advise them of matters of interest, including notification of Fleet Program changes. However, neither THINK GAS nor its service providers, partners, affiliates or the Think Gas ROs will be liable for any failure to do so and will not be responsible for correspondence lost or delayed in the mail. The latest Terms and Conditions shall be available to the Fleet Member on request or can be viewed on the website of the Fleet Program (Website).

General Terms & Conditions for Online Payments

1. Once a User has accepted these Terms and Conditions, he/ she may register and avail the Services.

2. In these Terms and Conditions, the term “Charge Back” shall mean, approved and settled credit card or net banking purchase transaction(s) which are at any time refused, debited or charged back to merchant account (and shall also include similar debits to Payment Service Provider's accounts, if any) by the acquiring bank or credit card company for any reason whatsoever, together with the bank fees, penalties and other charges incidental thereto.

3. Server Slow Down/Session Timeout: In case the Website or Payment Service Provider’s webpage, that is linked to the Website, is experiencing any server related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment,, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:

In case the Bank Account appears to be debited, ensure that he/ she does not make the payment twice and immediately thereafter contact the Institute via e-mail or any other mode of contact as provided by the Institute to confirm payment.
In case the Bank Account is not debited, the User may initiate a fresh transaction to make payment.
However, the User agrees that under no circumstances the Payment Gateway Service Provider shall be held responsible for such fraudulent/duplicate transactions and hence no claims should be raised to Payment Gateway Service Provider No communication received by the Payment Service Provider(s) in this regards shall be entertained by the Payment Service Provider(s).

4. The Institute and the Payment Service Provider(s) assume no liability whatsoever for any monetary or other damage suffered by the User on account of:

The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Payment Gateway or Services in connection thereto; and/ or
Any interruption or errors in the operation of the Payment Gateway.

5. The User agrees, understands and confirms that his/ her personal data including without limitation details relating to debit card/ credit card transmitted over the Internet may be susceptible to misuse, hacking, theft and/ or fraud and that the Institute or the Payment Service Provider(s) have no control over such matters.

6. Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by the User, the Institute does not represent or guarantee that the use of the Services provided by/ through it will not result in theft and/or unauthorized use of data over the Internet.

7. The Institute, the Payment Service Provider(s) and its affiliates and associates shall not be liable, at any time, for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on the Website.

8. The User will be required to login his/ her own User ID and Password, given by the Institute in order to register and/ or use the Services provided by Institute on the Website. By accepting these Terms and Conditions the User aggress that his/ her User ID and Password are very important pieces of information and it shall be the User’s own responsibility to keep them secure and confidential. In furtherance hereof, the User agrees to;

Choose a new password, whenever required for security reasons.
Keep his/ her User ID & Password strictly confidential.
Be responsible for any transactions made by User under such User ID and Password.

Debit/Credit Card, Bank Account Details

1. The User agrees that the debit/credit card details provided by him/ her for use of the aforesaid Service(s) must be correct and accurate and that the User shall not use a debit/ credit card, that is not lawfully owned by him/ her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide correct and valid debit/credit card details.

2. The User may pay his/ her fees to the Institute by using a debit/credit card or through online banking account. The User warrants, agrees and confirms that when he/ she initiates a payment transaction and/or issues an online payment instruction and provides his/ her card / bank details:

The User is fully and lawfully entitled to use such credit / debit card, bank account for such transactions;
The User is responsible to ensure that the card/ bank account details provided by him/ her are accurate;
The User is authorizing debit of the nominated card/ bank account for the payment of fees selected by such User along with the applicable Fees.
The User is responsible to ensure sufficient credit is available on the nominated card/ bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by the User inclusive of the applicable Fee.

Payment Gateway Disclaimer

The Service is provided in order to facilitate access to view and pay Fees online. The Institute or the Payment Service Provider(s) do not make any representation of any kind, express or implied, as to the operation of the Payment Gateway other than what is specified in the Website for this purpose. By accepting/ agreeing to these Terms and Conditions, the User expressly agrees that his/ her use of the aforesaid online payment Service is entirely at own risk and responsibility of the User.

Cancellation Policy

Once the User will be registered and paid the Fee through online Payment Gateway. He/She will not be able to cancel the transaction in any circumstances. No Payment will be refunded to the User.

Payment Refund Policy for Online Payments

Refund for Charge Back Transaction: In the event there is any claim for/ of charge back by the User for any reason whatsoever, such User shall immediately approach the Institute with his/ her claim details and claim refund from the Institute alone. Such refund (if any) shall be effected only by the Institute via payment gateway or any other means as the Institute deems appropriate. No claims for refund/ charge back shall be made by any User to the Payment Service Provider(s) and in the event such claim is made it shall not be entertained.

Refund for fraudulent/duplicate transaction(s): The User shall directly contact the Institute for any fraudulent transaction(s) on account of misuse of Card/ Bank details by a fraudulent individual/party and such issues shall be suitably addressed by the Institute alone in line with their policies and rules.
